WeWork is seeking a Counsel, IP to join our dedicated team. As an industry leader with a global presence, WeWork maintains a dynamic portfolio of trademarks, copyrights, patents, and domains. In championing the WeWork brand, the Intellectual Property team oversees all aspects of clearing, protecting and enforcing WeWork’s IP assets and counseling on a wide variety of IP issues at the intersection of technology and innovation, e-commerce, retail, hospitality, and real estate. This position will report to the Director, IP and will be based in New York, NY. The ideal candidate will possess intellectual curiosity, identify issues and solve problems creatively, exercise sound business judgment, and be eager to deliver first-rate protection strategies in carrying out the goals of the organization.
What you’ll do:

  • Manage WeWork’s global trademark portfolio, including clearance, prosecution, and enforcement

  • Analyze trademark search reports and provide opinions and practical advice to business teams regarding the availability of brands for use and/or registration

  • Supervise IP enforcement matters, including international oppositions, cancellations, cybersquatting actions, and litigation. Draft C&D letters.

  • Negotiate and draft settlement agreements and co-existence agreements

  • Manage DMCA complaints and other takedown requests

  • Help manage WeWork’s global patent portfolio and develop strategy for the protection of trade secrets

  • Advise on OSS issues and technology transactions

  • Support marketing, product, and technology teams with the launch of new products and initiatives by advising intellectual property rights, ownership, and protection

  • Support commercial and M&A transactions, including conducting IP due diligence and contract review

  • Develop strategy and draft IP language in licenses, including technology, marketing, and franchise

  • Review marketing materials for compliance with intellectual property laws and licensing requirements

  • Conduct training to business and legal teams on intellectual property rights and laws

  • Support and represent WeWork in external IP engagements

What you’ll bring to the table:

  • 4+ years of experience in intellectual property law at law firm or in-house legal department

  • Experience with Google G-suite, Saegis, WebTMS

  • Strong organizational, interpersonal, written, and verbal communication skills

  • Ability to prioritize workload

  • A nimble and commercial approach to counseling

  • Effective collaboration and team player

  • Ability to work independently
