THE ROLE The Legal Counsel will support Tesla China relating to various forms of litigation, and will also support sales-related commercial issues. This position, based in Shanghai Lingang, will report directly to the Head of China Legal and will be part of the Tesla China Legal team.
RESPONSIBILITIES
  • as well as threatened litigation, to minimize the impact on Tesla.
  • Manage litigation portfolio and directly work on litigation matters, including handling all court procedures, review of pleadings, drafting submissions to court, and making recommendations to senior management on case strategy and case disposition.
  • Will be required to attend hearings, mediations and other duties as assigned.
  • Negotiate resolutions to litigation when appropriate.
  • Support the sales and delivery functions, including with respect to any issues affecting new vehicle sales, used vehicle sales, fleet sales and trade-ins.
  • Draft sales related commercial agreements and participate in the development of new business and sales model.
  • Prudently engage and manage outside legal resources as necessary with an eye toward minimizing expenses.
REQUIREMENTS
  • Minimum of 7 years with a top tier law firm or other in-house position, specializing in litigation.
  • Qualification in the PRC with solid working knowledge of PRC laws in the aforementioned subject areas.
  • Excellent academic credentials from top-ranked law school.
  • Native Mandarin speaker, plus fluency in English.
  • Overseas education and/or work experience preferred.
  • Ability to make sound business decisions quickly and in the face of ambiguity and uncertainty.
  • Strong command of the details of relevant laws and regulations but with an ability to make litigation matters understandable and actionable for Tesla management.
  • Experience with addressing litigation matters in the high-tech industry will be a plus.
  • Ability to effectively negotiate with opposing parties.
  • Well-organized with good analytical skills, excellent oral and written communication skills, proactive approach to file handling and caseloads, and able to work independently as well as within a team environment.
  • Efficient work habits with a hands-on approach.
  • Ability to manage and prioritize multiple projects.
  • Must possess strong inter-personal and organizational skills.
  • Ability to identify and resolve problems quickly.
  • Desire to work independently and cross-functionally in a fast-paced environment.
  • A creative problem solver who is open to new ideas and new approaches.
  • Willingness to work in a scrappy environment.
